Privacy Policy

This Privacy Policy explains how LeafWorks Inc. (“LeafWorks”) collects, uses, shares, and safeguards Personal Data on LeafWorks’ URL, as well as mobile websites and mobile applications, and any other digital services and platforms operated or used by LeafWorks from time to time (“sites”), as well as by phone or by paper.

It should be noted, as to communications to or from LeafWorks on social media platforms, that LeafWorks has no control over these third-party sites. They are subject to their own privacy policies which may conflict with LeafWorks’ privacy policy. Users are encouraged to examine the privacy policies of those platforms before attempting to communicate with LeafWorks in that manner.

I. CHANGES TO THE PRIVACY POLICY

The products and services LeafWorks offers may change from time to time. This Privacy Policy will change over time as well. LeafWorks reserves the right to amend this Privacy Policy at any time for any reason. The effective date of any changes or updates will appear next to the hyperlink to this Privacy Policy.

II. TYPES OF PERSONAL DATA COLLECTED BY LEAFWORKS

LeafWorks collects only limited categories of personal information. In order to serve the needs of our actual and potential customers and to conduct LeafWorks’ business, we may collect the names and log-in IDs of persons and organizations; physical addresses of persons or businesses; email addresses of persons or businesses; telephone and mobile numbers for persons and businesses; financial information necessary to process payments for products and services rendered (examples include, but are not limited to, credit card and debit card numbers and bank account numbers, passwords and/or pin numbers); shipping information (such as shipping addresses); any supplied photographs; and other information that LeafWorks’ determines in good faith is needed to carry out and document its business with respect to our actual and potential customers and any claims or disputes therewith. Otherwise, LeafWorks only accepts nonpersonal commercial information, such as, but not limited to, information about customers’ samples and collections, the locations of same, and photographs of same.

LeafWorks does not presently use internet “tracking cookies,” or any other sort of internet “cookies.” Should it ever start to use “tracking cookies” or “cookies,” this will be disclosed to you through an update in this Privacy Policy.

LeafWorks will not disclose or sell personal data for commercial purposes to third parties at this time. Such disclosures that do occur are those that become necessary for LeafWorks to fulfill service requests or perform business functions for the customer, or for normal and customary business purposes such as accounting and compliance. Such business functions include such things as transfers relating to contracts with third parties to provide services on our behalf such as data hosting services; packaging, mailing and delivery services; or customer support and consulting services. Otherwise, should LeafWorks ever start disclosing such data to third parties for commercial purposes, this will be disclosed to you through an update to this Privacy Policy.

LeafWorks may, of course, have to make disclosures required by lawful court or regulatory orders, or where LeafWorks believes in good faith that such action is necessary to: (1) conform to legal requirements or comply with legal process served on LeafWorks; (2) protect or defend LeafWorks’ rights or property; or (3) protect the personal safety of LeafWorks personnel or members of the public in appropriate circumstances.

Should LeafWorks and/or its assets, or a portion of these assets, ever be sold, assigned, transferred, or merged; should LeafWorks ever go through bankruptcy; or should LeafWorks ever experience a change in its corporate form, information may be transferred as part of that transaction or change.

LeafWorks may have to share your personal information with third parties if it is ever necessary for LeafWorks, in LeafWorks’ good faith belief, to take security measures to help protect against unauthorized access to or unauthorized alteration, disclosure, or destruction of data.

III. HOW LEAFWORKS USES YOUR DATA

At this time, LeafWorks is primarily using the personal data described above to facilitate the ordering of LeafWorks’ products and services by its actual and potential customers, the delivery of those products and services to those customers, payment for those products and services by those customers, and, as determined in good faith by LeafWorks, to carry out, resolve, and document its business with respect to our actual and potential customers and any claims or disputes therewith, and to comply with LeafWorks’ other legal, regulatory, taxation, securities, and accounting standards and obligations. LeafWorks may use your personal data to provide you with service communications such as bill reminders, order confirmations, program registrations and customer service messages. We may use personal data to respond to communications you send us, whether written, oral, by telephone, or electronic, including requests for products or services. We may use your personal data to deliver and process surveys. We also may use your personal data to send you information about new products and services LeafWorks has introduced or may introduce in the future. LeafWorks reserves the right to change how it uses such personal information in the future, but when it exercises this right, it will update this Privacy Policy to reflect such changes and explain how personal data provided to it or obtained by it will then be used.

IV. THIRD-PARTY SITES

The LeafWorks website may contain links to other websites for your convenience. Please be aware that those other websites are not operated by or controlled by LeafWorks, and you may be subject to the privacy policies of those websites, rather than this Privacy Policy. The privacy policies may contain different provisions from this Privacy Policy. To ensure your privacy is protected, we recommend that you review the privacy statements of these other linked sites, applications, or digital platforms.

V. HOW YOU CAN MANAGE THE PROCESSING OF YOUR PERSONAL DATA, OR ACCESS, CHANGE AND DELETE YOUR PERSONAL DATA

You can manage your profile and email preferences, including “opting out” of email by contacting us using the information in the “Contact Information” section below. Our processing of your data is based upon your consent, contract performance (e.g., your purchase of products or services), legitimate business interest (e.g., marketing, purchase, sale, delivery of goods and services, compliance with accounting, taxation or securities requirements, or resolutions of claims and disputes with you in litigation, arbitration or other dispute resolution, among others), or compliance with law, regulation, legal, taxation or securities-law obligations, or other legal compulsion. 

LeafWorks relies on you to update and correct your Personal Data.  If you are a user of our Sites or a purchaser of our products and services, you can review, update and correct your information directly on our website in many cases, or by contacting us using the information in the “Contact Information” section below. Typically, we retain your Personal Data for the period necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law or deemed by LeafWorks in good faith to be necessary or appropriate as permitted under this policy.  This may include retaining your Personal Data indefinitely in order to provide you with future marketing opportunities and for other purposes, as well as to comply with our legal obligations, resolve disputes, enforce any of our agreements, ensure that our business and accounting records comply with applicable accounting standards or requirements or taxation or securities-law requirements, and that our business operations are properly documented.  Please note that you can request, at any time, that we delete your Personal Data, and such requests will be considered in good faith.  All requests must be directed to the contact in the “Contact Information” section below.  LeafWorks can decide itself to delete your Personal Data if we believe that the data are incomplete, inaccurate, or that our continued use and storage are contrary to our obligations to other parties or are no longer commercially necessary or appropriate.  When we delete your Personal Data, it will be removed from our active databases or anonymized so that the data is no longer identified with you, but the data may remain in our archives if LeafWorks determines that it is not practical or possible to delete it or as otherwise permitted hereunder.

VI. CHILDREN

LeafWorks does not knowingly collect Personal Data from, or market to, children under 18 years of age.

VII. HOW LEAFWORKS PROTECTS PERSONAL DATA

LeafWorks implements commercially reasonable security measures to help protect against unauthorized access to or unauthorized alteration, disclosure, or destruction of data. Except as set forth in this Privacy Policy, we restrict access to Personal Data to certain third parties who need the data to operate, develop, or improve our products or services or to sell, provide or deliver our products or services to you. These organizations are bound by confidentiality obligations and may be subject to discipline, including contractual termination if they fail to meet these obligations.

Unfortunately, no data transmission over the Internet or electronic storage is fully secure. Accordingly, and despite our reasonable efforts to protect your Personal Data from unauthorized access, use, or disclosure, LeafWorks cannot guarantee or warrant the security of the Personal Data you transmit to us, or which are transmitted to or from our online Sites.

VIII. USER ID AND PASSWORD

Certain areas of LeafWorks’ Sites require the use of a user ID, email address, or password as an additional security measure that helps protect your Personal Data. To help you protect your privacy, these Sites have tools to help you log in and log out.

IX. TRANSMISSION OF DATA TO OTHER COUNTRIES

Your Personal Data is stored and processed in the United States only. If you reside in another country, you should be aware that United States privacy laws may be less stringent than the laws in your country. Further, in the United States, the government, courts, and/or law enforcement may be able to access and process your Personal Data in ways they would not be able to access or process it in other countries. By submitting your data to LeafWorks, you agree to the transfer, storage and processing of your Personal Data in the United States.
